COMSAT Communications Satellite Cooperation

Until this decade the U.S.-based Comsat, Intelsat and Inmarsat organizations, in fact, shared nearly all international satellite traffic. So it was easy for NSA to eavesdropping on all communications to and from the United states. Less than 60 miles from Sugar Grove COMSAT runs a station in Etam, West Virginia, where more than half of the commercial, international satellite communication entering and leaving the US each day pass by. COMSAT provides international communications solutions via the global, 19-satellite INTELSAT system and 4-satellite Inmarsat satellite systems .

Through the INTELSAT system, COMSAT provides telecommunications, broadcast and digital networking services between the U.S. and the rest of the world. These services are used by Internet service providers, multinational corporations, telecommunications carriers and U.S. and foreign governments to extend their networks globally.

Inmarsat satellites lie in geostationary orbit 22,223 miles (35,786 km) out in space. Each satellite covers up to one third of the Earth's surface and is strategically positioned above one of the four ocean regions.

Calls are beamed up to the satellite and back down to Earth, where special gateway land earth stations re-route them through the appropriate local or international telephone network. COMSAT operates Earth Stations in each part of the world to route calls efficiently within each ocean region. Earth Stations are located in Santa Paula, California; Southbury, Connecticut; Ankara, Turkey; and Kuantan, Malaysia.

Sugar Grove Naval Communications Facility, near Sugar Grove, WV, may intercept Pacific INTELSAT/COMSAT satellite communications traffic routed through the COMSAT ground station at Etam, WV.

NSG station in Winter Harbor, Maine serves as an excellent platform from which to intercept signals to and from COMSATs Andover station, 125 miles to the west.

On the Westcost, COMSATs northern groundstation is situated in Brewster, near to Yakima, so from the Yakima Research Station the Pacific INTELSAT communications traffic can be intercepted.

The other west-coast station is in Jamesburg, California, not so far away from the Army Security Agency intercept station at Two Rock Ranch.

The international communications network with its limited gateways will probably always be easier to monitor than the large domestic networks like in the US. But the use of microwave and domestic satellites is increasing, and the construction of land lines is decreasing.

Media Control and the Influence of Public Discourse

As citizens rely on information to make political choices, media are an important element in the process of public opinion formation. They decide which topics and issues are on the agenda or not; which individuals or societal groups are given broadcasting time or publishing space and which aspects and facts are presented or suppressed. Media therefore have the ability to influence public opinion and those controlling the media are to a certain extent capable of altering the nature of discourse in their desired direction.

Problems of Copyright Management and Control Technologies

Profiling and Data Mining

At their most basic copyright management and control technologies might simply be used to provide pricing information, negotiate the purchase transaction, and release a copy of a work for downloading to the customer's computer. Still, from a technological point of view, such systems also have the capacity to be employed for digital monitoring. Copyright owners could for example use the transaction records generated by their copyright management systems to learn more about their customers. Profiles, in their crudest form consisting of basic demographic information, about the purchasers of copyrighted material might be created. Moreover copyright owners could use search agents or complex data mining techniques to gather more information about their customers that could either be used to market other works or being sold to third parties.

Fair Use

Through the widespread use of copyright management and control systems the balance of control could excessively be shifted in favor of the owners of intellectual property. The currently by copyright law supported practice of fair use might potentially be restricted or even eliminated. While information in analogue form can easily be reproduced, the protection of digital works through copyright management systems might complicate or make impossible the copying of material for purposes, which are explicitly exempt under the doctrine of fair use.

Provisions concerning technological protection measures and fair use are stated in the DMCA, which provides that "Since copying of a work may be a fair use under appropriate circumstances, section 1201 does not prohibit the act of circumventing a technological measure that prevents copying. By contrast, since the fair use doctrine is not a defense e to the act of gaining unauthorized access to a work, the act of circumventing a technological measure in order to gain access is prohibited." Also the proposed EU Directive on copyright and related rights in the information society contains similar clauses. It distinguishes between the circumvention of technical protection systems for lawful purposes (fair use) and the circumvention to infringe copyright. Yet besides a still existing lack of legal clarity also very practical problems arise. Even if the circumvention of technological protection measures under fair use is allowed, how will an average user without specialized technological know-how be able to gain access or make a copy of a work? Will the producers of copyright management and control systems provide fair use versions that permit the reproduction of copyrighted material? Or will users only be able to access and copy works if they hold a digital "fair use license" ("fair use licenses" have been proposed by Mark Stefik, whereby holders of such licenses could exercise some limited "permissions" to use a digital work without a fee)?

Industrial design refers to the ornamental aspect of a useful article which may constitute of two or three-dimensional elements. To be qualified for intellectual property protection the design must be novel or original. Protection can be obtained through registration in a government office and usually is given for 10 to 15 years.
